Terms & Conditions

1. Hirer Requirements

The Hirer must:

• Be at least 18 years of age
• Hold a valid driver's licence
• Provide valid identification upon request

2. Hire Period

The hire period begins at the agreed start time and ends at the agreed return time. Late returns will incur additional charges at the standard daily hire rate. Continued failure to return equipment may result in recovery action and additional costs.

3. Payment & Bond

• Full hire fee must be paid prior to collection
• A refundable security deposit is required
• The bond will be refunded once equipment is returned in acceptable condition

4. Additional Charges

The Hirer agrees to pay all additional charges incurred during the hire period, including but not limited to:

• Fuel charges
• Cleaning fees
• Damage or repair costs
• Recovery or transport costs
• Tolls, fines, or penalties
• Any other costs arising from the hire

5. Use of Equipment

The Hirer agrees to:

• Operate equipment safely and competently
• Use equipment only for its intended purpose
• Not allow unauthorised persons to operate equipment
• Not sub-hire, sell, or transfer equipment

6. Towing & Transport

The Hirer is responsible for ensuring their vehicle is suitable and legally rated to tow the equipment or trailer. Logan Hire Pty Ltd reserves the right to refuse hire if the vehicle is deemed unsuitable or unsafe.

7. Equipment Responsibility & Liability

The Hirer is fully responsible for the equipment from the time it leaves the premises until it is returned and inspected. The Hirer is liable for:

• Damage to equipment
• Loss or theft
• Damage to third-party property
• Injury caused during use
• Recovery or transport costs

8. Insurance & Excess

Logan Hire Pty Ltd maintains insurance for certain risks; however, the Hirer remains responsible for all applicable excesses and uninsured losses. Minimum excess amounts may apply:

• Equipment damage – from $1,000
• Theft – from $4,000
• Liability claims – from $2,500

9. Distance & Usage Restrictions

Equipment must not be taken more than 500km from the Logan Hire premises. Use beyond this distance voids insurance coverage, and the Hirer will be fully responsible for all costs. A $500 penalty may apply.

10. Breakdown

In the event of breakdown:

• Stop using equipment immediately
• Notify Logan Hire Pty Ltd
• Do not attempt repairs without approval

11. Fuel Policy

Equipment is supplied full of fuel and must be returned full. Failure to do so will incur $3 per litre plus a $30 administration fee. Incorrect fuel use will result in full liability for repairs and downtime.

12. Cleaning

Equipment must be returned clean. Cleaning fees may apply if returned excessively dirty.

13. Late Returns

Late returns will incur additional hire charges. Continued failure to return equipment may result in recovery action and additional costs. Failure to return equipment may result in the matter being reported and further action taken.

14. Theft or Loss

The Hirer must report theft or loss immediately and notify police. Failure to take reasonable care may result in full replacement costs being charged.

15. Recovery & Repossession Rights

Logan Hire Pty Ltd reserves the right to recover or repossess equipment without notice if the Hirer breaches these Terms & Conditions or fails to return the equipment. All recovery and associated costs will be charged to the Hirer.

16. Delivery & Collection Disclaimer

Where delivery or collection is arranged, Logan Hire Pty Ltd is not liable for any delays or failure due to circumstances beyond its control.

17. Indemnity

The Hirer agrees to indemnify and hold harmless Logan Hire Pty Ltd against any claims, damages, losses, or expenses arising from the use or misuse of the equipment during the hire period.

18. Equipment Condition

The Hirer acknowledges that the equipment has been inspected and accepted in good working condition unless otherwise recorded in the Condition Report.

19. Right to Refuse Hire

Logan Hire Pty Ltd reserves the right to refuse hire at its discretion.

20. Agreement

By proceeding with the hire, the Hirer agrees to these Terms & Conditions.
